Update? I'm not part of any exclusive 'in the know' club, but I did lose an awful lot of cash with these people and would be grateful if anybody could give an update re possible action against the directors, or anybody else for that matterRegards

Fraud Just be looking up legal definitions of fraud, part of which states: 'A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.'The concealment part is interesting.

More company news For those still interested, the new articles of association of Whalsay Energy Ltd have now been published by companies house. Some interesting amendments to the usual Table A blurb.Also a few more names for your delectation. Tim Sweeting is a director of Whalsay Energy Holdings Ltd, and Brendan Galloway has been appointed as an observer to the board of directors.and bless their little cotton socks:"Staff Incentive Plan" means the employee plan to be established by Whalsay and approved by the holder(s) for the time being of more than 75% of the total number of ordinary shares in the capital of Whalsay, pursuant to which options for up to 12% of the entire issued share capital of Whalsay may be awarded to Employees in a manner to be determined by the board of directors of Whalsay taking into account appropriate tax advice.

Re: Stitched up by fairclough? SweetjudyWhalsay Energy Limited is just the new name of Xcite Energy Resources Limited/ plc as was. Whalsay is the UK operating company of Bentley which was sold to a Newco in the Cayman Islands by the liquidators of XEL.Fairclough might be a director of Whalsay but he owns none of it. The bondholders who brought the liquidation action own Whalsay through the Cayman Newco. That's my interpretation anyway.
